TERMS & CONDITIONS

GENERAL

1. By participating, Entrants agree to be bound by all conditions outlined in these Terms & Conditions for the Kansom Australia Online Store’s SHOP & WIN: Two-Night Getaway to Apollo Bay Competition.

2. All entries must comply with the Terms & Conditions to be considered a valid entry.

COMPETITION PERIOD

Open: 12AM (AEST) on Wednesday 1st March 2023

Closed: 11.59PM (AEST) on Friday 30th June 2023

WHO CAN ENTER

1. Entry is open to all Australian residents who are over 18 years of age at the time of the promotion, except employees and immediate families of Kansom Australia Pty Ltd (the Promoter), Apollo Bay Fisherman’s Co-Op and associated companies/agencies.

2. For the purpose of this clause, “immediate families” means any of the following: spouse, de facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, or fist cousin whether or not they live in the same household as the employee or contractor.

3. The time of entry for each Entrant for this competition will be the date and time that an eligible order has been placed on the Kansom Australia Online Store (www.kansom.com.au). The date and time information can be located on your order invoice.

4. The Promoter reserves the right to request winners to provide proof of identity, proof of residency or proof of entry validity in order to claim the prize. Proof of identity, residency, or entry validity suitable for verification is at the discretion of the Promoter.

HOW TO ENTER

1. This Competition is a game of chance.

2. To enter, the entrant must make an online purchase of AUD $100.00 or more, excluding shipping, at the Kansom Australia Online Store (www.kansom.com.au) during the competition period to obtain a valid entry.

3. All valid orders will be automatically entered. Entrants will be entered into the competition based on their Billing Address details provided on their order purchase.

4. Entrants will receive 1 additional bonus entry during the competition period for orders including of the following Hamper & Gift Pack Products: Gourmet Essentials Hamper; Gourmet Indulgence Hamper; Australian Seafood Essentials Hamper; Australian Seafood Ultimate Hamper; Abalone & Sea Sauce Gift Pack; Kansom 3 Can Gift Pack; Gold Prince 3 Can Gift Pack; Sea Sauce Range in 180ML Glass Jar – 5 Pack; Unwind & Pamper Gift Hamper; Pamper & Treats Gift Hamper; Self-Pamper Gift Hamper.

5. Entrants are able to enter as many times as they like, subject to valid entry.

6. Entrants need to keep a copy of their receipt/order for the winner to claim their prize.

7. Entrants can only enter under their own name. Entering under a false name(s) may invalidate all entries.

8. Any entry cannot be modified after it has been entered.

9. Any costs associated with entering this Competition are the responsibility of each Entrant.

10. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which do not comply with these Terms and Conditions, or which contravene any applicable law as or regulations. Entries will be deemed void if stolen, forged, mutilated, or tampered with in any way.

DRAW & PRIZES

1. The Competition ends at 11.59PM (AEST) on Friday 30th June 2023 and The Prize will be drawn electronically at Kansom Australia Pty Ltd.

2. The Prize is not transferrable and is not redeemable for cash. The Prize must be taken as stated and no compensation will be paid if the Winner is unable to use. In the event that The Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute The Prize, or element of it, of equal or greater value.

3. The Winner must be ready, willing, and able to receive and/or participate in The Prize as required by these Terms and Conditions.

4. The first eligible entry drawn will win The Prize as described below. The Promoter will draw five (5) reserve entries and record them (in order drawn) in case an invalid entry or ineligible entrant is drawn as a winner or the winner is unable or unwilling to accept the prize.

5. The Prize (Total Prize Pool of $1490.00) consists of the following:
   

   1. Two-Nights Accommodation at Two Night Accommodation at The Apollo Apartments in Apollo Bay for 2 People Valued at $850.00:
      

      1. Two-Nights Accommodation is valid for use only at Apollo 13 Apartment, subject to availability. Accommodation must be booked for use for any dates, subject to availability, between 20th July 2023 and 31st January 2024.

      2. Subject to availability, accommodation booking may be rebooked to an alternate date between 20th July 2023 and 31st January 2024, with any cancellation/reschedule booking fee(s) at the Winner’s cost.

      3. Two-Nights Accommodation does not include travel expenses to, from and around Apollo Bay.

   2. Abalone & Food Hamper Valued at $250.00. Hamper will be provided to the Winner in the apartment during their stay.

   3. Fisherman’s Dinner for 2 at Apollo Bay Fisherman’s Co-Op Fish & Chip Shop Valued at $200.00. Voucher will be provided to use at the Apollo Bay Fisherman’s Co-Op Fish & Chip Shop. Voucher will be valid for use between 20th July 2023 and 31st January 2024.

   4. Winner’s Choice of Voucher for 2 People for Wildlife Wonders Experience:
      

      1. “Share the wonder of a Walk with Wildlife” Valued at $59.00 Per Person; or

      2. “Share the wonder of a Dawn Discovery Tour” Valued at $95.00 Per Person; or

      3. “Share the wonder of a Dusk Discovering Tour” Valued at $95.00 Per Person.

6. The Winner of this Promotion will be notified by email to their nominated email address by Monday 10th July 2023. In this email the winner will be sent instructions regarding how to verify their entry (including Proof of Identity) and how to redeem their prize. The winner’s name will also be published on the Website by Monday 10th July 2023.

7. The Winner of this Promotion must verify their entry (including Proof of Identity) and accept the Prize by 11.59PM 17th July 2023. In the event Winner is unable to verify and accept, the Promoter will contact the next reserve entry. The reserve entry Winner must verify and accept prize within 3 business days from the Promoter notifying them.

8. In condition of accepting a prize, the Winner agrees to participate in and cooperate with all reasonable media editorial requests, including but not limited to, being interviewed, photographed and filmed and the Winner grants the Promoter a perpetual, non-exclusive licence (if applicable) to use, and continuously releases and indemnifies the Promoter from and against any use of, such footage and photographs in all media worldwide, and the Winner will not be entitles to any fee for such use.

9. The Promoter reserves the right to alter the rules of the competition at any time.

PRIVACY POLICY

1. The Promoter will collect Entrants’ personal information in order to conduct the Competition as well as an adverting, promotional materials, and publications in relation to the Competition. The collection use and disclosure of personal information provided in connection with Competition is governed by the Promoter’s Privacy Policy.

2. Entrants consent to the Promoter using the Entrant’s Name and State and Suburb in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome) and promoting any goods or services provided by the Promoter.

3. By entering this competition, the Entrant consents to receipt of information regarding the Competition and other emails or communications which inform the Entrant of the Promoter’s other publications, products, services, and events to promote third party goods and services the Entrant maybe interested in. The promoter may continue to provide the Entrant with this information for an indefinite period unless and until otherwise advised by the Entrant.

4. Entrants’ personal information may be disclosed to State and Territory lottery departments as required under the relevant lottery legislation.

ADDITIONAL TERMS

1. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any later, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted, or misdirected entries, claims or correspondence whether due to error, omission, alternation, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks or lines and accepts no responsibility for any problems associated with them. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred.

2. The Promoter and associated agencies and companies shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

3. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

4. Any disputes relating to the conduct of the promotion or the claiming of a prize are to be resolved by the Promoter in their absolute and sole discretion and subject to applicable law or direction of a relevant authority.

5. The Promoter’s decisions in relation to the Promotion are final and no correspondence will be entered into.
